The former D.C. mayor and current D.C. Council member representing Ward 8 will not be going to jail. So ruled a federal magistrate judge on Wednesday. Federal prosecutors wanted Barry to serve jail time for violating his probation for failure to file his D.C. and federal taxes.

As The Post's Carol Leonnig reports, Magistrate Judge Deborah Robinson said that prosecutors had not proven that D.C.'s so-called mayor-for-life "willfully failed to file his income tax returns."

  • Isn't failing to file your income tax returns against the law? He wasn't just late a couple of days either. Judge Deborah Robinson is clearly out to lunch. This is a travesty of justice.
